B.N.M — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the B.N.M website and your purchase of products from B.N.M.
Throughout these Terms, “B.N.M”, “we”, “us” and “our” refer to B.N.M. “Customer”, “you” and “your” refer to any person accessing the website or purchasing products from us.
By accessing our website, placing an order or purchasing a product, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return & Refund Policy.
Nothing in these Terms is intended to exclude, restrict or waive any mandatory right available to a consumer under applicable Indian law.
1. Eligibility to Use the Website
You may place an order only if you are legally competent to enter into a contract under applicable law.
Where a person places an order on behalf of another person or business, that person represents that they have authority to do so.
2. Product Information
B.N.M makes reasonable efforts to ensure that product descriptions, specifications, sizes, materials, photographs and other information displayed on the website are accurate.
Because product colours may appear differently depending on screen settings, lighting and device displays, minor visual variation may occur.
This does not permit B.N.M to supply goods that are materially different from their description or otherwise deny any remedy available under applicable consumer law.
Customers should review product descriptions and size information before purchasing.
3. Prices and Taxes
Prices displayed on the website are stated in Indian Rupees unless otherwise indicated.
Applicable taxes, shipping charges or other mandatory charges will be displayed or disclosed before completion of the transaction as required by applicable law.
B.N.M will not intentionally impose undisclosed mandatory charges after an order has been placed.
4. Placing an Order
When you submit an order, you are making an offer to purchase the selected product on these Terms.
Receipt of an order confirmation or payment acknowledgement does not necessarily mean that the order has been dispatched.
B.N.M may conduct reasonable order, payment, inventory, fraud-prevention or COD verification checks before dispatch.
An order may be rejected or cancelled before dispatch where there is a legitimate reason, including:
- Product unavailability;
- Payment failure;
- Suspected fraudulent activity;
- Material pricing or technical error;
- Incorrect or incomplete customer information;
- Delivery location being unserviceable;
- Legal or regulatory restrictions; or
- Other circumstances that reasonably prevent fulfilment.
Where B.N.M cancels a prepaid order, the applicable refund will be processed according to the Return & Refund Policy and applicable law.
5. Payment
Available payment methods may include prepaid electronic payment methods and Cash on Delivery (“COD”), depending on eligibility and availability.
Electronic payments may be processed through authorised third-party payment service providers.
Customers must not use payment instruments fraudulently or without appropriate authority.
B.N.M does not request customers to disclose confidential banking credentials such as UPI PINs, card PINs, CVVs or internet-banking passwords through ordinary customer-support communication.
6. Cash on Delivery
COD availability may depend upon delivery location, courier support, order value, customer history or fraud-prevention requirements.
COD orders may require OTP, telephone, WhatsApp or other reasonable verification before dispatch.
Repeated fraudulent orders, intentional misuse or repeated unjustified refusal of confirmed COD orders may result in COD being restricted for future purchases, where permitted by law.
Any such restriction does not affect statutory consumer rights relating to defective, damaged, wrongly supplied or misrepresented goods.
7. Shipping and Delivery
Shipping, estimated delivery times, failed delivery attempts, lost shipments and delivery-related matters are governed by our Shipping & Delivery Policy.
Delivery estimates are not guarantees where delays arise from circumstances beyond reasonable control, but statutory remedies remain available where applicable.
8. Order Cancellation
Customers may request cancellation before dispatch or before fulfilment reaches a stage at which the shipment can no longer reasonably be stopped.
A cancellation request becomes effective only when the cancellation is successfully processed or confirmed.
Cancellation rights and refund consequences are governed by our Return & Refund Policy and applicable law.
B.N.M will not use these Terms to impose cancellation conditions prohibited by the Consumer Protection (E-Commerce) Rules.
9. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by the B.N.M Return & Refund Policy.
The existence of a commercial return window does not remove any statutory remedy that may apply where goods are defective, deficient, damaged, spurious, materially misdescribed or otherwise supplied in violation of applicable law.
10. Customer Responsibilities
Customers are responsible for providing accurate:
- Name;
- Contact number;
- Email address;
- Delivery address;
- PIN code;
- Size selection; and
- Other information necessary to fulfil the order.
Customers must not knowingly submit false, fraudulent or misleading information.
11. Prohibited Use
You must not use the B.N.M website:
- For unlawful or fraudulent activity;
- To impersonate another person;
- To make unauthorised payments;
- To interfere with website security or operation;
- To introduce malware or malicious code;
- To scrape or misuse website content unlawfully;
- To infringe B.N.M or third-party intellectual-property rights; or
- For any activity prohibited by applicable law.
B.N.M may restrict access where reasonably necessary to protect customers, the business or the website from abuse or unlawful activity.
12. Intellectual Property
Unless otherwise stated, the B.N.M name, logos, brand elements, product photographs, graphics, text, designs, website content and other original materials are owned by or licensed to B.N.M.
They may not be reproduced, commercially exploited, modified or distributed without permission except where permitted by applicable law.
Nothing in these Terms transfers ownership of B.N.M intellectual property to the customer.
13. Third-Party Services
Our website may use third-party services including Shopify, payment processors, courier companies, analytics providers and communication services.
Those providers may operate under their own terms and privacy practices.
Use of third-party providers does not remove responsibilities that applicable law places directly on B.N.M.
14. Website Availability
We aim to keep the website operational and accurate but cannot guarantee uninterrupted access at all times.
Temporary interruption may occur because of maintenance, technical faults, hosting issues, payment-provider failures, cyber incidents or circumstances beyond reasonable control.
Where a technical failure affects a customer's payment or order, B.N.M will take reasonable steps to investigate and provide an appropriate resolution.
15. Pricing or Technical Errors
If a genuine technical, typographical or pricing error occurs, B.N.M may contact the customer before dispatch to correct the issue.
Where an order cannot lawfully or reasonably be fulfilled because of a genuine error, B.N.M may cancel the affected order and refund any amount received.
This provision will not be used to engage in misleading pricing practices or unfair trade practices.
16. Fraud and Abuse Prevention
B.N.M may use reasonable fraud-prevention measures to protect customers and the business.
Orders may be held for verification where circumstances reasonably indicate potential fraud, unauthorised payment, identity misuse or abuse of COD.
Any personal information used for fraud-prevention purposes will be handled in accordance with applicable privacy law and our Privacy Policy.
17. Limitation of Liability
To the maximum extent permitted by applicable law, B.N.M will not be liable for indirect or consequential losses that were not reasonably foreseeable and are not caused by a breach for which the law imposes liability.
However, nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
In particular, nothing in these Terms limits rights or remedies relating to:
- Fraud;
- Wilful misconduct;
- Product liability;
- Defective or unsafe goods;
- Misrepresentation;
- Unfair trade practices; or
- Mandatory consumer rights.
18. Force Majeure
B.N.M will not be treated as having intentionally failed to perform an obligation where performance is prevented or materially delayed by circumstances genuinely beyond reasonable control, including severe natural events, war, civil disturbance, government restrictions, major transport disruption, widespread telecommunications failure or similar events.
Where such circumstances affect an order, B.N.M will make reasonable efforts to communicate with affected customers and provide available remedies.
19. Consumer Protection
B.N.M recognises the rights available to consumers under the Consumer Protection Act, 2019 and applicable rules.
Nothing in these Terms shall be interpreted as:
- Waiving a consumer's mandatory statutory rights;
- Preventing a lawful complaint before a Consumer Commission or competent authority;
- Allowing an unfair trade practice;
- Permitting misleading representations; or
- Avoiding product-liability obligations imposed by law.
The Consumer Protection Act includes dedicated provisions governing consumer protection, product liability and ecommerce, and the E-Commerce Rules apply to inventory and other ecommerce models selling goods through electronic networks.
20. Contract and Sale of Goods
Transactions entered into through B.N.M are governed, where applicable, by principles of contract formation under the Indian Contract Act, 1872 and sale-of-goods requirements under the Sale of Goods Act, 1930.
The Sale of Goods Act contains protections relating to sale by description, conditions and warranties, quality or fitness, delivery and examination of goods.
21. Governing Law
These Terms are governed by the laws of India.
Any dispute will be subject to the jurisdiction of courts, Consumer Commissions or other competent authorities having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to surrender a statutory forum or remedy available under Indian consumer law.

B.N.M will handle consumer grievances in accordance with the timelines and requirements imposed by applicable ecommerce and consumer-protection law.
23. Severability
If any provision of these Terms is held invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The affected provision will be interpreted as closely as possible to its lawful commercial purpose.
24. Changes to These Terms
B.N.M may update these Terms from time to time because of changes in law, business practices, products or website functionality.
Updated Terms will be published on the website with a revised “Last Updated” date.
Changes will ordinarily operate prospectively and will not unlawfully remove rights relating to orders already placed.
25. Entire Agreement
These Terms, together with the applicable product information, Return & Refund Policy, Shipping Policy, Privacy Policy and other policies expressly incorporated into them, form the terms governing purchases made through the B.N.M website.
If there is a conflict between these Terms and a mandatory requirement of applicable law, the mandatory law will prevail.
